Unjustly Sentenced to Eight and a Half Years in Prison, Musician Mr. Jin Yuan Is in Critical Condition

On the morning of June 24th, 2011, Mr. Jin Yuan, former musician with the Anhui Province Song and Dance Troupe from Zhuhai, was sentenced to eight years and six months in prison by the Xiangzhou District Court in Zhuhai City. He is presently detained in Yangjiang Prison and he is in a precarious situation. Mr. Jin was previously arrested in 2001, brutally beaten up, tortured, and sent to a forced labour camp for three years.

Mr. Jin Yuan was detained in Zhuhai Detention Centre's No. 2 Branch after his house was ransacked and he was seized by the Zhuhai police on November 10th, 2010. In September 2011, he was taken to Yangjiang Prison.

Mr. Jin became severely ill while in detention. At one point he was unconscious for two days and he was obviously still in poor health after being transferred to prison. Despite his condition, prison wardens continued to torture him using various means, to force him to give up his belief. His family was told they could not visit him because he was “emotionally unstable.”

Information indicates that Mr. Jin's situation is dire and that his life may be in danger.

Second Prize Winner of the National Youth Erhu Music Competition Sent to Forced Labour and Tortured

Mr. Jin Yuan came in second in the National Youth Erhu Music Competition. He started to practise Falun Gong in 1998.

In early 2001, Mr. Jin was arrested by the Zhuhai police. He was first detained in the Zhuhai No 1 Detention Centre and subsequently sent to three years of forced labour.

At the detention centre, Jin Yuan was locked up with death row inmates and others with heavy sentences. Police instructed prison guards and about a dozen criminals to torture him with various brutal means. He was beaten up the first day until he lost consciousness and fell to the ground. As a result of the abuse, his eardrum was punctured and he lost his hearing. Afterward he was not allowed to eat or sleep and he was made to carry out forced labour. He was routinely beaten up by prison guards. In the cold winter, he was continuously drenched from head to toe with cold water for more than two hours. In over one month's time, Mr. Jin was tortured until he was on the verge of death.

When information about his precarious situation leaked out, his family and society were shocked and concerned for his plight. With the help of kindhearted people, Mr. Jin's desperate situation was eased. Because of his steadfast belief in Falun Gong, he very quickly recovered his health and his eardrum healed. However without any legal basis, the Public Security Department, Procuratorate and legal system sentenced him to three years of forced labour.

Arrested Again and Sentenced to Eight and a Half Years in Prison

After Mr. Jin regained his freedom, in order to let more people know about the beauty of Falun Gong so that they could benefit from it, he made many pretty amulets1 at home to give to people.

On November 10th, 2010, at 8:00 a.m., police officers Lai Haizhong, Che Xuecan, and others from the Xiangzhou Domestic Security Division broke into his house and arrested him. They also ransacked his place until around noon, taking away equipment he used to make the amulets, a computer, printers, and completed amulets. The police even stole his personal savings account book.

On April 25th, 2011, Xiangzhou District Court tried Mr. Jin. An experienced human rights lawyer defended Mr. Jin and proved that he should immediately be released. However the public prosecutor and judge did not respond.

On June 24th, 2011, in the morning, Xiangzhou District Court went ahead and sentenced Mr. Jin to eight and half years in prison.

What His Family Went Through

Mr. Jin's wife is a dancer and the heavy pressure of her husband's persecution fell on her shoulders. Their son is still young and unable to take care of himself, yet he has to take up the responsibility of helping and comforting his mother. Mr. Jin's elderly mother is severely ill. She only has one lung and relies on an oxygen tank to help her breathe. While enduring extreme pain, she waits for and hopes to see her son again.

Mr. Jin's father used to be a local high-ranking official and was reputed to be a non-corrupt official. He was so agonized by his son being treated like a criminal, arrested, and sentenced to jail, that he developed severe back problems.
