The Persecution of Falun Dafa Practitioners in Biamiao Forced Labour Camp

Quan Peijun, Zhang Yongli and Xu Xiaowu, were imprisoned Falun Gong practitioners in the Third Group of Baimiao Forced Labour Camp. During the National holiday in October 2001, they were savagely tortured for two days because they practised the Falun Gong meditation exercises in a recreation room. These actions were ordered by He Xianglong, the director of the Third Group of Baimiao Forced labour Camp. The police either handcuffed or tied the practitioners' hands behind their backs (several criminals were summoned to help the police with the beating). They kicked and hit the practitioners, beating them with four or five electric batons. The practitioners were shocked with high voltage electric batons for more than half an hour. Practitioners were shocked repeatedly on multiple locations including their heads, necks, ears, faces, lips and other places. The most vicious person was the group leader, who shocked the practitioners on their genitals

On November 15, 2001, practitioner Quan Peijun shouted "unacceptable" during a forced anti-Falun Gong "re-education by torture" class at the Baimiao Forced Labour Camp. Camp officials ordered the practitioners to attend an exhibition defaming Falun Gong against the practitioners' will. The forced anti-Falun Gong brainwashing class was held in the Henan Science and Technology Building. During the class, Quan Peijun was beaten by officials doing the presentation and shocked with electric batons by He Xianglong, the director of the Third Group. In another instance, around January 14, 2002, practitioner Qu Mengchao did not want to watch the TV programs in which Falun Gong was being slandered and subsequently chose to return to his cell. For this he was ganged up on and beaten by several criminals. The criminals hoped to either get their terms reduced or get authorities' praise by torturing practitioners. On January 15, 2002, Qu Mengchao stood up to speak his opinion at a meeting organised to attack Falun Gong. He Xianglong ordered several people to beat Qu Mengchao and shock him with electric batons. Qu Mengchao's legs were injured so badly that he could not walk. After this incident, Qu Mengchao was locked up in an isolated cell.

The actions of the police in the labour camp severely broke the Administration Law of Education by Forced Labour. The law says that the use of electric batons is only applicable when a criminal resists arrest, and police should not physically punish prisoners. Besides that, they also broke the 248th item of criminal law regarding "infringement upon a citizen's right of personal freedom and democratic rights." Staff members in prisons, custody centres, detention centres and other jail systems are forbidden to beat, physically punish and torture prisoners. For severe acts, they will be subject to up to 3 years of detention as criminals. For extremely severe acts, the staff members could be sentenced to no less than 3 years, and up to ten years of detention as criminals. If they cause a prisoner's permanent disability and or death, the staff members will face even harsher sentences.

Based on definitions in the laws, "Beat" refers to violent conduct toward prisoners such as kicking, hitting, striking with sticks etc. "Physical punishment and torture" refers to all physical and mental torture except physical beating, such as forcing prisoners to stay in cold temperatures, denial of food, forcing prisoners to kneel down, do prolonged, heavy labour beyond their capability, locking up people in isolated cells, humiliating them, and using instruments of torture. "Inciting" refers to encouraging some prisoners to beat up other prisoners. "Inciting" is another way of "beating, physically abusing and torturing prisoners" and it is a criminal act. There is no fundamental difference between inciting others to achieve personal interest and personally directly performing it. The item clearly defines this situation.
