Summary of European Lawsuits against Jiang Zemin and his Accomplices from the Chinese Communist Party

Since July, 1999, Jiang Zemin has used the Chinese Communist Party to stage a campaign of genocide against Falun Gong. This unprecedented persecution has lasted for over five years and caused the deaths of at least 1,482 innocent Falun Gong practitioners. In addition, over 100 million practitioners, along with their families and friends, have experienced violations of human rights.

Meanwhile, Jiang Zemin’s faction has extended the persecution to overseas countries, doing substantial harm to Falun Gong practitioners outside of Mainland China, as well as Chinese citizens. To stop the evil persecution and to safeguard human rights and justice, Falun Gong practitioners from Europe, Asia, North America, Australia, and Africa, together with human rights organisations and human rights lawyers, have filed lawsuits against Jiang and his accomplices.

Falun Gong practitioners have no involvement in politics and take no interest in any political party, power or system. But everyone must be responsible for their behaviour and pay for what they have done. Those who took part in the persecution against Falun Gong cannot hide themselves behind any political party, power or system. The criminals can never justify their wrongdoing by making up the excuse that they were just following their superiors’ orders. No criminal is likely to escape from being brought to justice.

It is against the figures that are active in these human rights abuses that Falun Gong practitioners filed lawsuits. The defendants include China’s high-ranking officials who played leading roles in the persecution, as well as medium and low-level officials, such as university presidents, enterprise owners, and heads of forced labour camps who carry out their superiors’ orders to persecute Falun Gong for the sake of personal interest. The first lawsuit was filed in 2002. By 2004, many lawsuits had been submitted in several countries. The net of the law might have legal loopholes. Yet, those who took part in the persecution against Falun Gong will surely be brought through the courts if they do not cease their vile behaviour and repent for their crimes by doing good deeds.

Falun Gong practitioners in over ten European countries, including the Soviet Union and countries in Eastern Europe, filed lawsuits against Jiang Zemin and his accomplices. Following is a summary of the European lawsuits.

1) December 4th 2002: Legal action against Li Lanqing in France

On December 4th, Falun Gong practitioners in France initiated legal action against the head of China’s “6-10 Office,” Li Lanqing. The “6-10 Office” is the primary organ through which the Jiang regime carries out its state-run terrorism campaign against Falun Gong practitioners and is the highest institution within the Chinese government for formulating and executing the campaign to persecute Falun Gong. It is a terrorist organization specifically established for the purpose of suppressing and persecuting innocent Falun Gong practitioners who follow the principles of “Truthfulness, Compassion, Forbearance.” The systematic and tightly conceived persecution, aimed at eradicating Falun Gong and Falun Gong practitioners through both violent and psychological means, originated from this office.

Four Falun Gong practitioners from France, Ireland and Canada, with renowned human rights lawyers Georges-Henri Beauthier (France) and William Bourdon (Belgium), launched a legal action against Li Lanqing, who is also China’s Vice President and a former member of the Chinese Community Party’s Standing Committee. Li faces the charge of torturing Falun Gong practitioners in China. The four plaintiffs are French citizen Irena Petty, French resident Chen Zhumei, Irish Resident Zhao Ming and Canadian resident Wang Yuzhi.

In July, 2003, Li Lanqing was charged with crimes of torture. In Paris the case was in due legal process and under investigation.

2) August 20th 2003: Jiang Zemin, Luo Gan and Li Lanqing are subjects of legal action in Belgium

Entrusted by Falun Gong practitioners, on August 20th renowned Belgian human rights lawyer Georges-Henri Beauthier filed a lawsuit against Jiang Zemin, Luo Gan and Li Lanqing with the Federal Prosecutor ,charging them with torture, genocide, and crimes against humanity.

3) September 8th, 11th, 16th and 18th 2003: Four lawsuits against Luo Gan in Europe for torture and genocide

Luo Gan, head of the “6-10 Office”, played a leading role in the persecution against Falun Gong practitioners. He was served with four lawsuits for the crimes of genocide and torture during his visit to Europe in September 2003.

On September 8th, Ragnar Adalsteinsson, a renowned Icelandic human rights lawyer, submitted a criminal lawsuit against Luo Gan to the State Criminal Prosecutor Bogi Nilsson for torture, crimes against humanity and genocide.

On the morning of September 11th, entrusted by the Finnish Falun Dafa Association, Erkki Kannsto, a renowned Finnish human rights lawyer, also submitted a lawsuit to the police department and the Finnish Prosecutor’s Office against Luo Gan for crimes of torture and genocide.

On September 16th, Falun Gong practitioners filed a lawsuit with the court in the Armenian capital city Yerevan, charging Luo Gan with torture and genocide.

On September 18th, the international human rights organisation World Organisation to Investigate the Persecution of Falun Gong, an organisation called Rescue Our Family Members and the St. Petersburg Falun Dafa Association filed a class action lawsuit charging Luo Gan with torture, genocide and other crimes against Luo Gan during his visit to Moldova. Representatives from these organisations filed a lawsuit with Moldova’s Prosecutor General in the capital city Chisinau.

4) October 15th 2003: Jiang Zemin and Luo Gan are the subject of legal action in Spain

Fifteen Falun Gong practitioners from China, America, Australia, Belgium and Spain filed a criminal lawsuit in Spain’s High Court, charging Jiang Zemin and Luo Gan with torture and genocide in the oppression against Falun Gong practitioners.

5) October 27th 2003: Legal action against Wu Guanzheng in Cyprus

On October 27th 2003, Cypriot human rights lawyer Mr. Laris Vrahimis, representing persecuted Falun Gong practitioners, filed a lawsuit against Wu Guanzheng, former Provincial Secretary of Shandong Province and a current member of the CCP Politburo’s Standing Committee. Wu is one of the leading figures in the persecution against Falun Gong, and was charged in Cyprus with crimes against humanity, torture and genocide.

6) November 21st 2003: Lawsuit against Jiang and his accomplices in Germany

Lawyer Wolfgang Kaleck from Berlin, known as a representative for the German victims of the Argentine armed forces, was entrusted by the German Falun Dafa Association and forty Falun Gong practitioners from Germany, China, America, Canada, Australia and Ireland. He submitted charges to the Federal Prosecutor in Karlsruhe against the former Chinese leader Jiang Zemin and other senior officials and persons responsible fro the persecution of Falun Gong practitioners in China. The complaint charged them with genocide, crimes against humanity, torture and grievous bodily harm against Falun Gong practitioners in China:

The accused include:

  • Chinese head of state Jiang Zemin;

  • Li Lanqing, former Vice Premier and Director of the "6-10 Office;

  • Luo Gan, Standing Member of the Politburo of the Central Committee of the Chinese Communist Party and Vice Director of "6-10 Office”;

  • Xia Deren, Deputy Governor of Liaoning Province;

  • Liu Qi, former Beijing Vice Mayor and also President of the Beijing Planning Committee for the 2008 Olympic Games;

  • Zhao Zhifei, Deputy Head of Hubei Province's Department of Public Security;

  • Jiang Wanlai, Section Chief of the General Administration Department in Beijing Tuanhe Forced Labour Camp;

  • Yang Fenghua, Section Chief of the Education Department in Beijing Tuanhe Forced Labour Camp;

  • Jiang Haiquan, Deputy Leader of Branch Three in Beijing Tuanhe Forced Labour Camp;

  • Tu Chiwen, accused of murder in Beijing Tuanhe Forced Labour Camp;

  • Chuang Hsuhung, accused of murder in Beijing Tuanhe Forced Labour Camp;

  • Wang Chao, a prison guard in the Dispatch Office in Beijing Tuanhe Forced Labour Camp;

  • Sha Hsuehmei, a prison guard in the Dispatch Office in Beijing Tuanhe Forced Labour Camp;

  • Wang Chaofeng, a prison guard in Beijing Xinan Forced Labour Camp (now Beijing Female Forced Labour Camp);

  • Cheng Tsui E, a prison guard in Beijing Xinan Female Forced Labour Camp;

  • Chiao Hsuehhsien in Beijing Xinan Forced Labour Camp and the other defendants who are unnamed in the lawsuit, in particular the government officials and the heads of the "6-10 Office” in such seriously persecuted provinces as Liaoning Province, Jilin Province, Heilongjiang Province and Shandong Province, who are mentioned in the additional testimony (which is from the World Organization to Investigate the Persecution of Falun Gong).

7) November 26th 2003: Global Coalition to Bring Jiang to Justice asked the International Court to try Jiang Zemin

On November 26th 2003, the Global Coalition to Bring Jiang to Justice held a rally outside The Hague International Court. The coalition submitted printed materials about global lawsuits against Jiang to the first Judge of the International Court and requested a trial of Jiang Zemin.

8) January 28th 2004: China Culture Minister Sun Jiazheng subject of legal action in France for “incitement of massacre and persecution”

Four Falun Gong practitioners filed a lawsuit against the visiting Chinese Culture Minister Sun Jiazheng in the Paris Prosecutor’s Office. The complaint said that Sun Jiazheng, who is the China Culture Minister and co-chairman of the Web Culture Engineering Organising Committee, instigated public criticism and incited hatred of Falun Gong in order to eradicate Falun Gong through the use of newspapers, the Internet, and cultural exhibits. He is an accomplice of crimes of torture and is guilty of “incitement of massacre and persecution.”

9) April 16th 2004: Assistant Director of the Chinese Anti-Cult Association, Wang Yusheng, subject of legal action in Switzerland

On April 16th 2004, the Transnational Radical Party, a permanent international non-governmental organisation in the Geneva United Nations Office, held a special meeting on the topic of genocide. During the meeting, a Swiss attorney representative Ms. Boone announced a lawsuit against the Assistant Director of the Chinese Anti-Cult Association, Wang Yusheng. Seven lawyers agreed to accept this lawsuit filed by seven Falun Gong practitioners against Wang Yusheng. According to lawyer Hyard, the Geneva State Procurator has accepted this suit but if the legal process lasts too long the defendant could escape from the country upon becoming aware of the lawsuit against him, which could invalidate the lawsuit. Nevertheless, if the defendant enters Switzerland again, he will be subject of legal action again based on the United Nations Anti-Torture Treaty signed by both China and Switzerland.

10) May 5th 2004: Legal action against Bo Xilai UK

UK Falun Gong practitioners entrusted a lawyer to file a lawsuit against Bo Xilai for crimes of torture. The Metropolitan Police at New Scotland Yard accepted the formal allegation against Bo Xilai.

11) June 8th 2004: Lawsuit against Bo Xilai in Poland

Chinese Minister of Commerce Bo Xilai was subject to legal action in Warsaw for enthusiastically following former Chinese leader Jiang Zemin to persecute Falun Gong. Bo was accompanying Chinese President Hu Jintao to visit four nations in Europe and Asia, and Poland was their first stop. Falun Gong practitioners submitted a lawsuit to the Polish Procurator charging Bo with crimes against humanity and torture. The lawsuit alleges that Bo enthusiastically persecuted Falun Gong when he was Mayor of Dalian City and Governor of Liaoning Province. He also spent huge amount of taxpayers’ money to build new prisons in which Falun Gong practitioners were detained and persecuted. The lawsuit was filed based on Polish National Criminal Law, the UN Human Rights Treaty and the International Anti-Torture Treaty signed by Poland.

12) July 2nd 2004: Legal action against Li Changchun in France

On behalf of three Falun Gong practitioners, lawyer Delva filed a complaint to the Republic Procurator of Tribunal de Grande Instance de Pairs, accusing Li Changchun of being an accomplice to torture in the persecution of Falun Gong. Meanwhile, Li Changchun, a Politburo Standing Committee Member of the CCP Central Committee and former Guangdong Province CCP Secretary, was visiting France. The three plaintiffs in the case are as follows: Chinese-Australian Falun Gong practitioner Ms. Dai Zhizhen, Ms. Chen Ying, currently a resident of France, and Ms. Chen Zhumei, also residing in France.

13) July 2004: China Requested to Investigate the Crimes Committed by Li Lanqing and Sun Jiazheng

In December 2002, on behalf of French Falun Dafa practitioners, renowned French human rights attorney William Bourdon, who was part of the legal action to successfully bring Chilean dictator Pinochet to justice, and human rights lawyer Georges-Henri Beauthier from Belgium filed a lawsuit against Li Lanqing, former Deputy Prime Minister of China who was in charge of the “6-10 Office,” a Gestapo-like organisation of the Chinese Communist Party that specifically suppresses Falun Gong. Li was charged with being an accomplice to torture. In January, French Falun Dafa practitioners entrusted French lawyer Ms. Phelizon to file a lawsuit against Sun Jiazheng, Chinese Minister of Culture and President of the so-called “Internet Ethics Committee,” charging him with abusing Internet technology to defame Falun Gong. He was further charged with demonising Falun Gong in the areas of national culture and inciting hatred among people toward Falun Gong, as well as blocking all truthful information about Falun Gong and the persecution against its practitioners.

In July 2004, the Examining Magistrate who is in charge of this case sent a Commission Rogatoire Internationale (CRI) to China’s counterpart department, requesting related Chinese authorities to cooperate in the corresponding investigation. It is believed that this is the first CRI sent to China in French judicial history and it is perhaps also the first in European judicial history.

14) July 24th 2004: Chief diplomat of the Chinese Embassy in St. Petersburg Chen Yichu subject of legal action in Russia

On behalf of the persecuted Falun Gong practitioners, the St. Petersburg Falun Dafa Association sued the chief diplomat of the Chinese embassy in St. Petersburg, Chen Yichu, for defaming Falun Gong on TV and ruining the reputation of Falun Gong practitioners.

15) August 5th 2004: Complaint filed against Jiang Zemin, Li Lanqing and Luo Gan in Greece

Two Greek lawyers, on behalf of three practitioners from Australia, Ireland and Greece, submitted a criminal lawsuit against former Chinese President Jiang Zemin, former Vice President Li Lanqing and member of the Standing Committee of the Political Bureau of the Communist Party Luo Gan for genocide and torture. The lawsuit is based on Greek criminal law. Plaintiffs in the case are Irish resident Zhao Ming, Australian citizen Chris, who is originally from Greece, and Greek citizen Francis.

16) August 9th 2004: Lawsuit against Bo Xilai in Russia

Russian Falun Gong practitioners submitted a lawsuit to the Russian Procurator against the visiting Chinese Minister of Commerce, Bo Xilai. The lawsuit charged Bo with crimes against humanity, torture and genocide. It alleges that Bo enthusiastically persecuted Falun Gong when he was Mayor of Dalian City and Governor of Liaoning Province. The lawsuit was based on Article 357 of Russian criminal law.

17) August 12th 2004: Lawsuit against He Goan, Vice Consul of the Chinese Consulate in Habarovsk City, Russia

The Moscow Falun Dafa Association launched legal action against He Goan, Vice Consul of Chinese Consulate in Habarovsk City, for spreading propaganda against Falun Gong during his visit to Irkutsk City.

18) August 30th 2004: Lawsuit against Jia Qinglin in Austria

During Jia Qinglin’s a visit to Austria, the Austrian Falun Dafa Association, the International Human Rights Association, the “Society for Threatened People” and Falun Gong practitioners who have been persecuted in Beijing jointly submitted a lawsuit to the Vienna Procurator. Jia was accused of brutally torturing Falun Gong practitioners.

19) September 2nd 2004: Lawsuit against Jia Qinglin in Spain

During Jia Qinglin’s visit to Spain, fifteen Falun Gong practitioners submitted a lawsuit against him to the Spanish National Court in Madrid. Jia had been indicted for crimes of genocide and torture against Falun Gong practitioners when he was the Communist Party Secretary General of Beijing between 1999 and 2002. The fifteen plaintiffs of the case or their families had been subjected to brutal persecution in Beijing between 1999 and 2002.

20) November 13th 2004: Huang Ju sued in Ireland

Five Falun Gong practitioners filed a complaint against Chinese Vice Premier Huang Ju at an Irish police station for conspiring to implement the brutal torture against Falun Gong. On November 17th, lawyer Ms. Helen McGovern learned from the Irish Police Commission that the Deputy Commissioner had appointed two special investigators, Bill Donoghue and P.J. Browne, to look into this case.

21) November 29th 2004: Lawsuit against four “6-10 Office” Representatives in Spain

On November 29th 2004, after hearing that four “6-10 Office” representatives would be visiting Europe with a tourist group, Spanish Falun Gong practitioners immediately reported to Spain’s Highest Police Office that the four criminals who are persecuting Falun Gong practitioners in China might be entering Spain. In addition, practitioners handed in evidence of the crimes committed by the four people and testimonies of witnesses to the police, while demanding that the police immediately investigate all four of them. They are Zhang Xiaoguang of Heilongjiang Province, Zhang Xianlin of Beijing, Dong Zongfang of Shandong Province and Gao Kuixian from Jilin City.

The Spanish police quickly reported the case to Spain’s Highest Anti-terror Police Station and State Court. They investigated whether the four criminals had entered Spain. According to the investigation, these four criminals had not yet appeared in the list of Chinese tourist groups entering Spain. The Spanish police said, “These four people have been put on record by the Highest Police Office. Once they step into Spain, the Spanish Police will have the right to summon and interrogate them.” In the meantime, the lawyer representing Falun Gong practitioners officially filed the lawsuits against Zhang Xiaoguang, Zhang Xianlin, Dong Zongfang and Gao Kuixian in Spain’s State Court. The lawsuits accused them of genocide and torture.

22) December 1st 2004: Jiang Zemin, Bo Xilai, and Li Lanqing subject to legal action in the Netherlands

Falun Gong practitioners and Dutch human rights lawyer Liesbeth Zegveld filed a legal complaint against Jiang Zemin, Li Lanqing and Bo Xilai, charging them with crimes of genocide and torture in the suppression of Falun Gong. The Public Prosecutor personally received the complaint at the National Court in Rotterdam and expressed that she would study it and decide what action to take against the defendants.

23) January 28th 2005: Complaint filed against Gu Binglin, Wu Jianmin, Chen Zhu, and Wang Qinghai in Switzerland

On behalf of persecuted Falun Gong practitioners, the Swiss Falun Dafa Association and the World Organisation to Investigate the Persecution of Falun Gong submitted a lawsuit to the Swiss State Procurator. The accused included the President of Tsing Hua University Gu Binglin, President of Beijing Diplomatic College Wu Jianmin, who was once China’s Ambassador in France, Vice President of the Chinese Academy of Sciences Chen Zhu, and President of Shongang Group Wang Qinghai. The defendants were charged with inciting public hatred toward Falun Gong, torture and genocide. They drafted and carried out the rules to persecute the students, professors, staff, and employers of their units. The Swiss State procurator accepted the lawsuit, put it on record and started to investigate the crimes committed by the accused.

European Falun Gong practitioners will work together with Falun Gong practitioners in China and other countries to bring all of those involved in the persecution to justice.
